Consent to collecting personal information

By accessing and registering to use EMGuidance Script, you consent to EMGuidance collecting and processing personal information about you for the specific purposes set out in this Notice. 

If you do not consent to us collecting and using your information, you should immediately stop accessing and/or using EMGuidance Script.

What personal information do we collect?  

We may collect the following information from you when you register to use EMGuidance Script:

  • Full name;
  • Email address;
  • Telephone number;
  • Professional registration number
  • Professional council membership details 
  • Areas of speciality 
  • Country 
  • IP address
  • Browser details

Giving us this information is voluntary. However, if you do not give us this information, we obviously will not be able to provide any of the products or services you request from us.

 

What do we use your information for?

The information we collect from you may be used in one of the following ways:

  • To conclude a contract with you for your use of EMGuidance Script;
  • To prevent fraudulent use of EMGuidance Script and all underlying software, code, databases and other components of the platform;
  • To secure EMGuidance Script and all related networks and systems, and to communications exchanged between users and the platform;
  • To personalize and improve your experience of EMGuidance Script;
  • To improve customer service, your information helps us to more effectively respond to your customer service requests and support needs;
  • To process transactions;
  • To comply with our obligations under any law;
  • To send periodic emails about updates to our other products and services, and other information about EMGuidance. 

Please note that we only collect and process your information for one or more of the above purposes and for no other purpose unless we have your express consent to such further processing beforehand. 

 

Do we only collect information from you via the EMGuidance Script platform? 

We will only collect information about you directly from you when you register an account to use and access EMGuidance Script. If we ever need to collect information about you from another source, we will try to get your consent beforehand unless it is not reasonably practicable to do so. 

We may also obtain information about you that is already part of a public record or has already been made public by you. 

If are unable to contact you before we collect your information from another source, we will notify you within a reasonable time after we have done so and will advise you on what information about you has been obtained from that source. 

 

How long do we keep your information for?

We will only keep your information for a limited time until the purpose for which we collected your information has been met. After that we will then delete or destroy it, unless we need to keep it for longer for evidential reasons or to comply with other legal obligations. 

We may keep user information for statistical or research purposes, provided that we have removed any unique identifiers which can be used to link that information to you.

 

How do we keep your information secure?

We implement and maintain a variety of security safeguards to keep your information in our possession secure against internal and external risks, taking into account generally accepted information security practices and procedures. 

All information is transmitted via Secure Socket Layer (SSL) technology to secure servers and then encrypted on our database. Encrypted information is only made accessible to our authorized personnel or third party service providers who have access rights to our systems, and who are bound by legal duties of confidentiality.

We do not store any credit card or other sensitive financial or personal information on our servers after a transaction has been completed.

If the security of our systems or our service providers’ systems is ever breached, and your information is leaked or shared with someone who is not authorised to have it, we will notify you as soon as it is reasonably possible in the quickest way possible to help you avoid or reduce any potential losses. 

 

How can you access, correct and/or update the information we have in our possession?

You have the right to ask, free of charge, whether we have a record of any of your personal information and, if so, the details of the information we have in our possession or under our control. 

If you need any assistance with submitting an access request to any record of your personal information held by us, please contact our Information Officer at yaseen@emguidance.com.

While we take reasonably practical steps to make sure our records containing your personal information are always complete, accurate and updated when necessary, you must notify us immediately if you believe any information in our possession is inaccurate, incomplete or out-dated. We will then investigate the matter and if the information is found to be incorrect, incomplete, inaccurate, irrelevant, excessive, out-dated, misleading or was not collected according to the terms of this Notice, we will correct, update or delete that information within a reasonable time, and provide you with an updated record of the amended information or confirmation of what has been done.

If you notify us that any of the information we have about you is not correct or accurate, or needs to be updated, we will immediately stop using that information until we have either corrected or updated it, unless we can show that the information is actually correct and up to date.

If there is any dispute between us regarding the accuracy, correctness or completeness of your personal information, we will flag the disputed information on our system and make any third parties aware of the dispute.  

 

Do we share your information with anyone else?

We do share your personal information with trusted and reputable service providers who assist us in storing and processing information for the efficient and effective operation of the EMGuidance Script platform and the delivery of related products and services.  

We may also be required to share your personal information with public bodies or other parties to comply with our legal obligations or to protect our rights and legitimate interests, including in terms of the following legislation:  

  • Health Professions Act 56 of 1974 (and its regulations);
  • Medicines and Related Substances Act 101 of 1965 (and its regulations); and 
  • Pharmacy Act 53 of 1974 (and its regulations).

We do not sell, trade, or otherwise transfer your personal information to any other persons. 

We may also share certain de-identified usage information with outside parties for statistical and research purposes or marketing, advertising, or other uses. We employ reasonable safeguards to ensure that any de-identified information cannot be re-identified. 

 

Do we transfer your information to other countries?

It may be necessary for us to transfer your information to a jurisdiction other than South Africa when using the services of third party service providers who assist us in the efficient and effective operation of the EMGuidance Script platform and/or when providing our products and services to you. 

When we do need to transfer your information to another country, we will only do so if that country has sufficient legal protection available to protect your personal information. 

 

Do we use cookies?

Cookies are small files that we use on the EMGuidance Script platform, which transfers to your computer’s hard drive through your web browser (if you allow it) and enables us to recognize your login details, browser details and to capture and remember certain information about your settings and preferences.

We use cookies to make the EMGuidance Script platform and our users' experience more efficient and to help us improve our services.

 

Direct marketing 

Once you become a user of our products and services, we may contact you from time to time by post, telephone, fax, e-mail, SMS, or other electronic messaging services with offers of similar products or services, or information that may be relevant and useful to you. By registering to use any of our products or services and providing us with your contact details, or the contact details, you consent to being contacted by these methods for marketing purposes. 

If you do not want to receive any marketing communications from us, please contact script@emguidance.com. 

If you have previously indicated that you do not want to receive any marketing communications, you don’t have to do anything further. 

If at any time you would like to unsubscribe from receiving future marketing communications, we include detailed unsubscribe instructions at the bottom of each communication. 

 

Complaints

We respect your right to privacy and undertake to only collect and use your personal information with your consent, or when it is necessary and relevant to our business functions and activities, and then only according to the terms set out in this Notice. 

If you are not happy with anything we do in relation to your personal information, you may lodge an objection or complaint by emailing the EMGuidance Information Officer at yaseen@emguidance.com. 

If your objection or complaint is not resolved to your satisfaction, you have the right to lodge a complaint with the Information Regulator (South Africa). The contact details for the Information Regulator are:
